BIDDER acknowledges that an auction site is a potentially hazardous area. Every person at the auction site before, during and after the auction sale shall be deemed to be there at his own risk. Auctioneer reserves the right to refuse any applicant for a bidding card, or the privilege of bidding at this auction and to revoke such privilege at any time.
AGENCY: The Auctioneer is acting as agent only and is not responsible for the acts of its principals or consignors.
CONDITION OF ARTICLES SOLD: The auctioneer is not responsible for the correct description, genuineness, authenticity of, or defects in any lot, and makes no warranty in connection therewith. No sale will be set aside for allowance made on account of any incorrectness, error in cataloging, or any imperfection not noted. No deduction allowed on damaged articles, all goods being exposed for public exhibition, and sold “as is” and without recourse.

TERMS - You must be 18 years old to register and present a valid driver’s license. Payment for all items must be made IN FULL ON Sale Day in Cash, Certified Check or Company Check accompanied by a current Bank Letter guaranteeing payment to Auction Liquidation Services. At the time of complete settlement you will receive a paid sale receipt. You or your trucker must present paid receipt for release of equipment from the sale site.

SALES TAX: There is 6% Sales Tax where applicable. In the event the New Jersey State Division of Taxation deems the entire sale taxable, the buyer is responsible for the tax due on his purchases.
DISPUTE BETWEEN BIDDERS: If any dispute arises between two or more bidders the auctioneer may decide the same or put the lot up for sale again at once, and resell to the highest bidder. The auctioneer’s decision shall be final and absolute. At knockdown (when it is sold to a high bidder) the equipment or vehicle becomes the sole responsibility of the new purchaser.
RECORD: The record of sale kept by the auctioneer and bookkeeper will be taken as final in the event of any dispute.
REMOVAL: All purchases must be removed no later than Friday, June 30, 2006 by 5:00 PM. No lot can, on any account, be removed during the sale. Removal shall be at the expense, risk and liability of the purchaser. Purchases will be delivered only on presentation of paid bill. Buyer is responsible for removing and loading of equipment purchased.

ONLINE BIDDING TERMS & REGISTRATION
All Internet Buyers must provide a bank Letter of Guarantee. All Letters must be faxed to 1-908-842-0427. The Letter must be as follows:
“Mr. (Customers Name) is a customer in good standing with our bank. We will guarantee the payment of checks on his account (account number) up to (specify amount) dollars for purchase at your auction in (Auction Location) on (Auction Date). We hereby agree that no stop payment will be issued in conjunction with this letter.
There is a 2% Internet Purchase Fee charged on all online purchases, plus Auction Liquidation Services charges a 1% Service Fee.
Applicable State of NJ Sales Tax will be charged on all Lots. Bidders from outside the State of NJ will be exempt from Sales Tax if they provide an approved tax exemption status form and exception certificates that are acceptable to the State of NJ.
Payment in full must be made in full by June 24, 2006 in the form Cash, Wire Transfer, Cashiers Check or a Company Check accompanied with a bank letter of guarantee.
All Purchases must be removed from the premises by June 30, 2006.
Bidders are to be held personally liable for any bids made with their bidding number.
The highest bidder for each Lot shall be the Purchaser, and in the event of any dispute the Auctioneers shall have absolute discretion either to settle such dispute or to re-offer the lot for resale.
The Auctioneer and Equipmentfacts.com accepts no liability for loss or damage howsoever arising (including but not limited to costs of attendance of Bidders at the Auction) from any Lots not presented for sale.
The Auctioneer and Equipmentfacts.com has described the Lots in the catalog to the best of their ability and belief from information furnished by the Vendors who shall be alone responsible for any error or miss-statement, which there may be. The Auctioneer and Equipmentfacts.com undertake no liability whatever in respect of any faults, deficiencies and errors of any descriptions, oral or printed, nor do they accept responsibility for the authenticity, genuineness, origin, age, condition or quality of any Lots and all statements as to these matters whether contained in the catalog or made orally are statements of opinion only and not to be taken as being or implying a statement or representation of fact.
Each and every Lot is sold as seen. The Auctioneer and Equipmentfacts.com provides no guarantees or warranties (expressed or implied) in respect to the Equipment contained in the Lot. All representations made by the Auctioneer and Equipmentfacts.com, its servants or agents are to be considered lay opinions only and the Auctioneer and Equipmentfacts.com accepts no liability for any purchase made by a Buyer in reliance upon them.
The Buyer agrees to insure the Equipment purchased against all losses from the Auction Date until removal of the Equipment by the Buyer.
The Buyer acknowledges he/she has read and agrees to be bound by the additional terms and conditions set forth.
